Le Moyne Food Service Contract
1. Meal Plan Changes - If the student wishes to change his/her/their meal plan, the student must go to the Campus Life and Leadership Office within one week of the beginning of the Fall and Spring Semesters. No changes to meal plans will be made after those times. Meal plan changes MUST be made in person in the Campus Life and Leadership Office and cannot be made through the Bursar’s Office. In the case of withdrawal from the institution after the first week of the semester, requests for withdrawal from the remaining meal plan weeks must be justified in writing and received by the Campus Life and Leadership Office. Such requests may be granted or denied by the Director or Associate Director of Campus Life and Leadership in his/her/their sole discretion.
2. Dining Meal Usage - In order to be entitled to meals, the student must present my I.D. card each time he/she/they enter the College's Food Service facilities. Under no circumstances will the student use any other I.D. card except his/her/their own I.D. card in order to obtain meals. Lost or stolen I.D. cards should be reported to the Campus Life and Leadership Office as soon as possible. There is no reimbursement for meals lost because your I.D. card has been lost or stolen. Student agree that the meal plan selected is for his/her/their use only and that they are not permitted to transfer or assign any portion of meals to any other person. The student further recognizes and agrees that all dining facilities will be closed during the advertised breaks and between semesters and that the student must find other dining arrangements during these periods.
3. Meal Plans Rates and Payments – The student agrees to pay the applicable meal plan rate to which is selected with 50% of the total applicable meal plan charges prior to the beginning of the Fall Semester (first semester) and the remaining 50% prior to the beginning of the Spring Semester (second semester), at the places and dates established by the College for such payments. Meal plan rates are established per semester, and are not dependent of the length of time a student is required to be on campus for the purpose of academic activities. As a result, the student’s meal plan rate will be the same as other students selecting the same meal plan, even if the student is required to be on campus for a shorter period of time during the semester.
4. Refunds - In the event the Student has the College's written permission to leave the meal plan prior to the semester end, this Agreement may be terminated and the Student will be entitled to a prorated refund for meal plan charges, should the Student elect to discontinue the meal plan he/she/they has/have selected, proration is based upon the number of complete weeks which remain in the semester. For all purposes of this Agreement, a complete week shall run from Sunday through Saturday. Other than provided in section 6 and 7(c) below, no other refunds will be provided.
5. Safety Considerations - The Student acknowledges that the safety and security of both persons and property in the College's dining facilities shall be furthered by the Student’s participation in both individual and group security procedures as may be provided or developed during the academic year. The Student agrees to participate in the College’s security monitoring system and to abide by and maintain any entrance control system set up to enhance the safety and security of dining facilities.
6. Force Majeure - The College shall not be liable for failure to make dining available to the Student as described in this Agreement if and to the extent such failure results from any act of God, accident, equipment failure, loss of utility service, fire, flood, tornado, other natural disaster, labor dispute, inevitable accident, war, terrorist attack (or threat thereof), or any other cause outside the reasonable control of the College. In such event, except as otherwise provided in Section 4 and 7, refunds, if any, shall be determined by the College in its sole discretion, and will be paid only to the extent funded by proceeds available to the College from business interruption insurance coverage (if any) maintained by the College.
7. Special Notice to Students Regarding Potential Impact of the COVID-19/SARS-CoV-2 Pandemic and Related Matters - The COVID-19/SARS-CoV-2 pandemic continues to create risks and uncertainties associated with, among other things, the continued operation of college dining facilities. As of the date of this Meal Plan Contract, the potential continuing impacts of the pandemic are not fully foreseeable, and the parties acknowledge that the pandemic may impact the feasibility and conditions of Le Moyne College on-campus dining operations during some or all of the term of this Contract. Accordingly, the Student acknowledges and agrees as follows:
(a) The College may establish conditions, policies, rules and regulations for use of its dining facilities to account for actual or potential impacts of the COVID-19/SARS-CoV-2 pandemic, including but not limited to requirements for social distancing, the wearing of face coverings, sanitation, and/or health screenings as a condition for initial or continued dining. The Student agrees to comply with, and acknowledges that use of the College’s dining facilities is contingent upon the Student’s fulfillment of, any and all such lawful conditions, policies, rules and regulations.
(b) The College reserves the right to require the Student to temporarily refrain from using group dining facilities in the event that the College determines such action to be necessary or advisable in the event of a positive COVID-19 test or suspected exposure of the Student or any other person, or otherwise in connection with the COVID-19/SARS-CoV-2 pandemic (including but not limited to circumstances where the Student may be required to quarantine in an off-campus location or at the Student’s home address). In such circumstances the College may offer alternatives such as other dining locations, delivery or pick-up options if reasonably practicable. Changes in accordance with this paragraph shall not entitle the student to a refund or result in an abatement of meal plan charges.
(c) Except as provided in the preceding paragraph, if the College is required to cease food service operations by federal, state or local governmental authorities or applicable law, or if the College determines such action to be warranted, in light of continuing or potential impacts of the COVID-19/SARS-CoV-2 pandemic, the College will refund to the student a pro rata portion of the meal plan charges attributable to the complete weeks remaining in the semester at the time such action becomes necessary. The amount of any such refund will be based upon the portion of complete weeks of such semester during which the student was no longer permitted to use College food services. The College’s calculation of the amount of a refund pursuant to this paragraph shall be binding absent manifest error. If the student elects to withdraw his/her/their assigned meal plan based on concerns related to COVID-19/SARS-CoV-2 in the absence of such a mandated departure, refunds, if any, will be made in accordance to section 4 above.
By signing this contract, I understand and agree to all of the terms and conditions listed in the Le Moyne College Food Service Contract and to any subsequent revisions authorized by the College. I understand that if I am under 18 years of age this Agreement must also be signed by my parent or legal guardian as guarantor who will then, as guarantor, be fully liable for the performance of each and every obligation under this Agreement.
